4.ACCOUNT REGISTRATION

You must provide accurate and up-to-date information when registering.

You must promptly update your account information if it changes.

You must not:

  1. a.impersonate another person;
  2. b.create an account using information you are not entitled to use;
  3. c.create accounts for fraudulent, misleading or abusive purposes;
  4. d.allow unauthorised persons to use your login credentials; or
  5. e.attempt to circumvent restrictions by creating additional accounts.

We may require you to verify your identity, email address, business, domain or payment method.

5.ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of your account credentials.

You must use reasonable security measures to protect your account.

You must notify us promptly if you believe:

  • your account has been compromised;
  • your password has been disclosed;
  • an unauthorised person has accessed your account;
  • one of your connected accounts has been compromised; or
  • suspicious activity has occurred.

You are responsible for activity carried out through your account unless that activity results directly from our breach of our legal obligations.

We may temporarily restrict access where we reasonably believe this is necessary to protect you, GrowthZum, another user, a third-party service or the security of the Service.

6.TEAM MEMBERS

Certain subscriptions may allow multiple users.

The account owner or administrator is responsible for:

  • inviting appropriate users;
  • removing former employees or contractors;
  • setting access permissions;
  • ensuring team members comply with these Terms; and
  • ensuring team members are authorised to access relevant data.

Actions taken by authorised users will generally be treated as actions taken on behalf of the account holder.

Part C

Subscriptions, Trials And Payments

7.SUBSCRIPTION PLANS

GrowthZum may offer different subscription plans.

Features, usage allowances, prospect limits, sending limits, AI allowances, integrations, campaign limits and other restrictions may vary between plans.

The features included in your plan will be those stated on the GrowthZum website, pricing page, checkout page or account interface when you subscribe, subject to these Terms.

We may introduce new plans or change plan structures from time to time.

We will not materially remove a core paid feature from your current subscription without reasonable notice where doing so would materially disadvantage you, except where a change is necessary for legal, regulatory, security, technical or third-party-platform reasons.

8.FREE TRIALS

GrowthZum may offer a free or discounted trial.

Unless otherwise stated during registration, a trial lasts for the period displayed when you sign up.

Where payment details are required to begin a trial, the subscription may automatically convert to a paid subscription at the end of the trial unless you cancel before the trial expires.

The price that will apply following the trial will be displayed before the trial begins.

By starting such a trial, you authorise GrowthZum and its payment provider to charge the applicable subscription fee when the trial expires.

We may limit:

  • trials available to one individual;
  • trials associated with one business;
  • trials associated with one payment method;
  • trials associated with the same domain;
  • trials associated with the same email address; or
  • repeated attempts to obtain trial or promotional pricing.

We may refuse or end a trial where we reasonably believe the trial system is being abused.

9.SUBSCRIPTION FEES

Subscription fees are charged at the price displayed when you subscribe unless subsequently changed in accordance with these Terms.

Prices may be displayed inclusive or exclusive of VAT depending on the circumstances and information presented at checkout.

You are responsible for applicable taxes unless the law requires us to collect them directly.

10.AUTOMATIC RENEWAL

Unless otherwise stated, subscriptions automatically renew at the end of each billing period.

By subscribing, you authorise GrowthZum and its payment provider to collect the applicable subscription fee automatically from your selected payment method.

Your subscription will continue until cancelled.

11.CANCELLATION

You may cancel your subscription using the account area where this facility is available or by contacting:

hello@growthzum.com

Cancellation prevents the next renewal.

Unless we expressly state otherwise:

  • cancellation does not immediately terminate access;
  • you may continue using the Service until the end of the period already paid for; and
  • unused subscription time is not refunded.

Deleting a campaign, integration or user account does not necessarily cancel a paid subscription.

You should use the designated subscription cancellation process.

12.REFUNDS

Except where required by law, subscription fees are non-refundable once charged.

We do not normally provide refunds or credits for:

  • unused subscription time;
  • unused prospect allowances;
  • unused email allowances;
  • unused AI credits;
  • unused searches;
  • unused campaigns;
  • voluntary failure to use the Service;
  • incorrectly configured campaigns;
  • campaigns stopped by you;
  • suspension caused by your breach of these Terms;
  • restrictions imposed by a connected third-party provider;
  • email deliverability issues outside our control; or
  • poor campaign results.

Nothing in these Terms removes rights that cannot legally be excluded.

13.FAILED PAYMENTS

If payment fails, we may:

  • retry the payment;
  • notify you;
  • restrict paid features;
  • pause campaigns;
  • suspend sending;
  • downgrade the account; or
  • suspend access until payment is received.

You remain responsible for valid charges incurred before suspension or cancellation.

14.PRICE CHANGES

We may change our prices.

Changes to recurring subscription fees will normally apply from a future renewal date.

Where appropriate, we will provide reasonable advance notice of a material price increase.

If you do not accept the new price, you may cancel before the new price takes effect.

Part D

15.SERVICE LIMITS

GrowthZum may apply fair-use or plan-specific limits including limits on:

  • searches;

  • LinkedIn actions;
  • connected mailboxes;
  • connected accounts;
  • AI generation;
  • AI credits;
  • data enrichment;
  • exports;
  • team members;
  • storage; and
  • API requests.

Limits may be displayed within the Service.

You must not attempt to circumvent them.

16.AI CREDITS AND USAGE CREDITS

Some GrowthZum features may consume credits or usage allowances.

Credits:

  • have no monetary value;
  • cannot normally be redeemed for cash;
  • may only be used within GrowthZum;
  • cannot normally be transferred;
  • cannot normally be sold;
  • may expire where specified;
  • may be subject to plan limits; and
  • are not refundable merely because they remain unused.

Where an operation involves an external data provider, AI provider or verification provider, a credit may be treated as used when the relevant request is initiated, even if that provider does not return the result you hoped for.

We will make reasonable efforts to avoid duplicate charging caused by technical errors.

17.RATE LIMITS

GrowthZum may impose or alter rate limits to:

  • protect sending reputation;
  • reduce spam;
  • comply with third-party restrictions;
  • prevent abusive automation;
  • protect connected accounts;
  • maintain platform stability; or
  • reduce the likelihood of users breaching third-party rules.

We may adjust such limits without prior notice where reasonably required for operational, security, legal, deliverability or compliance purposes.

Part E

GrowthZum may obtain, infer, organise, analyse or display information from sources including:

  • publicly accessible websites;

  • public directories;
  • publicly available professional profiles;
  • information supplied by customers;
  • authorised third-party data providers;
  • connected services;
  • APIs; and
  • machine-generated or inferred information.

Prospect information may be incomplete, outdated, inaccurate or incorrectly attributed.

You must exercise reasonable judgement before relying upon it.

19.NO GUARANTEE OF DATA ACCURACY

GrowthZum does not guarantee that:

  • a person still works at a company;
  • an email address is valid;
  • a telephone number is current;
  • a job title is correct;
  • a company remains active;
  • company size information is exact;
  • an inferred email address belongs to the intended person;
  • a company matches your chosen criteria;
  • AI-generated research is correct;
  • a prospect wants to hear from you; or
  • contacting a prospect is legally permitted.

Scores or labels such as:

  • Strong Fit;
  • Good Fit;
  • Recommended;
  • Needs Confirmation;
  • Match Score; or
  • similar terminology

are software-generated indicators only.

They are not guarantees.

20.EMAIL ADDRESS GENERATION AND VERIFICATION

GrowthZum may generate possible email addresses using known business-domain patterns or obtain email addresses from authorised third-party sources.

Generated addresses are predictions.

A confidence score does not guarantee that an email address exists or belongs to the intended recipient.

Email verification services can reduce uncertainty but cannot guarantee deliverability, ownership or current use.

You remain responsible for deciding whether to use an address.

Part F

Artificial Intelligence

21.AI-GENERATED CONTENT

GrowthZum uses artificial intelligence and automated systems for some functions.

These may include:

  • prospect research;
  • company classification;
  • relevance assessment;
  • personalisation;
  • summaries;
  • email drafting;
  • LinkedIn message drafting;
  • follow-up drafting;
  • campaign recommendations;
  • website interpretation;
  • information extraction;
  • lead scoring; and
  • other automated features.

AI-generated information can sometimes be incorrect, misleading, incomplete or inappropriate.

You are responsible for reviewing AI-generated material where appropriate before relying upon or sending it.

22.NO GUARANTEE OF AI OUTPUT

We do not warrant that AI output will:

  • be factually correct;
  • be unique;
  • be error-free;
  • comply with every law relevant to you;
  • avoid all third-party intellectual property;
  • generate sales;
  • generate replies;
  • produce appointments;
  • be appropriate for every recipient; or
  • meet your commercial objectives.

You remain responsible for your use of AI-generated output.

23.AUTOMATED DECISIONS

Scores, recommendations and classifications produced by GrowthZum are intended to assist business decision-making.

GrowthZum is not designed to make decisions producing legal or similarly significant effects concerning individuals in areas such as:

  • employment;
  • lending;
  • creditworthiness;
  • insurance;
  • healthcare;
  • criminal justice;
  • housing; or
  • other regulated high-impact decisions.

You must not use GrowthZum for unlawful automated decision-making.

Part G

Email Outreach

24.CONNECTED EMAIL ACCOUNTS

GrowthZum may allow you to connect email accounts or services such as Gmail or other supported providers.

You authorise GrowthZum to access connected services only to the extent necessary to provide functionality requested or configured by you.

Depending on the integration and permissions granted, this may include authority to:

  • access relevant mailbox information;
  • prepare drafts;
  • send messages;
  • read or identify relevant replies;
  • identify message status;
  • store message metadata;
  • associate replies with campaigns; and
  • carry out actions requested by you through GrowthZum.

The exact permissions depend on the third-party service and the authorisation you grant.

25.YOU REMAIN THE SENDER

Where GrowthZum sends or schedules a message through your connected email account, you remain the sender of that communication.

GrowthZum provides software used to facilitate the communication.

You remain responsible for:

  • the recipient;
  • the content;
  • the commercial purpose;
  • lawful basis;
  • sender identification;
  • unsubscribe or opt-out arrangements;
  • suppression of recipients who object;
  • appropriate records; and
  • compliance with applicable marketing and privacy laws.

26.EMAIL DELIVERABILITY

GrowthZum does not guarantee inbox placement.

Emails may:

  • be rejected;
  • bounce;
  • be delayed;
  • enter spam or junk folders;
  • be quarantined;
  • be filtered;
  • be rejected by corporate security systems; or
  • negatively affect the reputation of your sending domain.

Deliverability depends on numerous factors outside our control, including:

  • your domain;
  • mailbox provider;
  • sender reputation;
  • historical sending behaviour;
  • message content;
  • sending volume;
  • mailbox configuration;
  • recipients;
  • spam filters; and
  • provider policies.

27.SENDING REPUTATION

You must use reasonable care when conducting outreach.

You must not knowingly use GrowthZum in a way likely to materially damage:

  • GrowthZum’s infrastructure;
  • shared infrastructure;
  • another user’s sending reputation;
  • third-party infrastructure; or
  • the reputation of a connected service.

We may pause, reduce or restrict sending where we detect significant:

  • bounce rates;
  • abuse reports;
  • spam complaints;
  • unusual sending patterns;
  • provider warnings; or
  • other indicators of material risk.

Features may change according to third-party platform restrictions and API access.

29.NO LINKEDIN AFFILIATION

Unless explicitly stated otherwise, GrowthZum is not affiliated with, endorsed by or sponsored by LinkedIn Corporation, Microsoft Corporation or any other third-party network merely because GrowthZum interoperates with or references that service.

Third-party names, logos and trademarks remain the property of their respective owners.

30.THIRD-PARTY PLATFORM RULES

You are responsible for complying with the terms and policies of third-party services you use.

You must not use GrowthZum to:

  • bypass technical restrictions;
  • defeat anti-abuse controls;
  • obtain unauthorised access;
  • scrape information where such activity is prohibited by law or contractual restrictions binding upon you;

  • create fraudulent accounts; or
  • undertake activity prohibited by an applicable third-party service.

GrowthZum may disable functionality where reasonably required to comply with third-party requirements.

31.CHANGES TO THIRD-PARTY ACCESS

Third-party services may:

  • change APIs;
  • alter permissions;
  • change pricing;
  • withdraw access;
  • restrict functionality;
  • change rate limits;
  • suspend integrations; or
  • prohibit particular uses.

GrowthZum is not responsible merely because a third party makes functionality unavailable to us.

We may modify, replace or discontinue affected features.

Where GrowthZum provides suppression functionality, you must use it appropriately.

You must not deliberately circumvent suppression functionality.

37.DO-NOT-CONTACT INFORMATION

GrowthZum may maintain suppression data to help prevent recipients who have opted out from being accidentally re-contacted through the Service.

You authorise GrowthZum to process such information for this purpose.

For the duration of your active subscription, GrowthZum grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Service for your internal business purposes in accordance with these Terms.

You may not sublicense or resell access unless GrowthZum expressly agrees in writing.

59.GENERATED OUTPUT

Subject to third-party rights and applicable law, you may use ordinary campaign content and AI-generated material produced specifically for you through GrowthZum for your business purposes.

AI systems may generate similar or identical material for different users.

GrowthZum does not guarantee that AI-generated output is unique or capable of intellectual-property protection.

60.FEEDBACK

If you voluntarily provide suggestions, ideas or feedback relating to GrowthZum, you permit GrowthZum to use that feedback without restriction or payment.

This does not transfer ownership of your confidential information to GrowthZum.

  • software updates;
  • infrastructure failure;
  • third-party outages;
  • internet disruption;
  • cyber incidents;
  • emergency maintenance;
  • provider restrictions; or
  • circumstances outside our reasonable control.

  • never become generally available.

You use beta features at your own risk.

64.PRODUCT CHANGES

GrowthZum is an evolving software service.

We may add, alter, replace or discontinue functionality.

We will take reasonable steps not to materially deprive paying customers of the overall core Service during a paid period without good reason.

This does not prevent GrowthZum changing functionality where required because of:

  • law;
  • regulation;
  • security;
  • abuse prevention;
  • third-party restrictions;
  • technical necessity; or
  • circumstances outside our reasonable control.

In particular, nothing excludes liability for:

  • suspension of a social-network account;
  • inaccurate information supplied by you;
  • your failure to honour opt-outs;
  • your failure to review AI-generated material; or
  • your reliance upon inaccurate prospect data where reasonable checking would have identified the issue.

72.LIABILITY CAP

Subject to clause 69 and any liability which cannot lawfully be limited, GrowthZum’s total aggregate liability arising out of or relating to the Service during any twelve-month period will not exceed the greater of:

  1. a.the total subscription fees actually paid by you to GrowthZum during the twelve months immediately preceding the event giving rise to the claim; or
  2. b.£500.

If applicable law requires a different limitation in order for a limitation to be enforceable, this provision will apply to the maximum extent legally permissible.

  • email providers;
  • data providers;
  • AI providers;

outside GrowthZum’s reasonable control.

Part S

Indemnity

74.BUSINESS USER INDEMNITY

To the extent permitted by law, where your unlawful or unauthorised use of GrowthZum causes GrowthZum to incur a third-party claim, regulatory claim, penalty, loss or reasonable legal cost, you will indemnify GrowthZum against such loss to the extent it results from:

  • content supplied or sent by you;
  • unlawful marketing carried out by you;
  • deliberate breach of opt-out requirements;
  • infringement of third-party rights by material supplied by you;
  • fraud by you;
  • deliberate misuse of GrowthZum; or
  • your material breach of these Terms.

This clause does not require you to indemnify GrowthZum for loss caused by GrowthZum’s own negligence, unlawful conduct or breach.

Part T

Suspension

75.WHEN WE MAY SUSPEND ACCESS

GrowthZum may suspend or restrict some or all access where we reasonably believe:

  • you have materially breached these Terms;
  • payment is overdue;
  • your account has been compromised;
  • you are sending unlawful spam;
  • you are committing fraud;
  • your activity threatens platform security;
  • your sending activity threatens deliverability or infrastructure;
  • you repeatedly ignore valid opt-outs;
  • a third-party provider requires suspension;
  • suspension is required by law; or
  • continued access creates material legal, regulatory, operational or security risk.

Where reasonable, we will give you an opportunity to remedy the issue.

We may act immediately where urgent action is required.

Part U

Termination

76.TERMINATION BY YOU

You may stop using GrowthZum at any time.

You may cancel a paid subscription in accordance with these Terms.

77.TERMINATION BY GROWTHZUM

GrowthZum may terminate your account immediately where:

  • you use GrowthZum for unlawful activity;
  • continued provision creates material legal or security risk;
  • you attempt to compromise GrowthZum;
  • you materially abuse GrowthZum systems or staff; or
  • we are legally required to terminate access.

For other material breaches, we will normally provide a reasonable opportunity to remedy the breach where appropriate.

78.EFFECT OF TERMINATION

When your account terminates:

  • your right to use GrowthZum ends;
  • active campaigns may stop;
  • connected integrations may stop operating;
  • recurring billing ends subject to amounts already due;
  • stored data may become unavailable; and
  • information may subsequently be deleted in accordance with GrowthZum’s retention practices.

You should export information that you are entitled to retain before your subscription ends where export functionality is available.

79.SURVIVING TERMS

Clauses intended by their nature to continue following termination will remain effective.

These include relevant provisions concerning:

  • intellectual property;
  • confidentiality;
  • payment;
  • liability;

  • accrued rights.
Part V

Confidentiality

80.CONFIDENTIAL INFORMATION

Each party may receive confidential information from the other.

A recipient must:

  • use confidential information only for the relevant contractual purpose;
  • take reasonable steps to protect it; and
  • not disclose it unnecessarily.

These obligations do not apply to information that:

  • is publicly available through no breach;
  • was already lawfully known;
  • is independently developed;
  • is lawfully received from another source; or
  • must be disclosed by law.
Part W

GrowthZum may contact you regarding:

  • your account;

These communications form part of operating the Service.

82.GROWTHZUM MARKETING

GrowthZum may separately send marketing communications concerning GrowthZum where permitted by law.

You may opt out of marketing communications.

Opting out of marketing does not stop essential service-related communications.

Part X

Privacy And Cookies

83.PRIVACY POLICY

GrowthZum’s Privacy Policy explains how GrowthZum processes personal information for its own purposes.

The Privacy Policy operates alongside these Terms.

84.COOKIES

GrowthZum may use cookies and similar technologies for purposes including:

  • authentication;
  • account security;
  • preferences;
  • analytics;
  • product operation; and
  • marketing,

subject to applicable law and GrowthZum’s Cookie Policy.

Part Y

Exports And Data Use

85.EXPORTING INFORMATION

Where GrowthZum permits data exports, you may export information for legitimate business purposes consistent with applicable law.

Exporting information from GrowthZum does not remove your obligations relating to that information.

Once information is exported, you are responsible for its security and subsequent use.

86.NO DATA BROKER RESALE

Unless GrowthZum expressly agrees otherwise, a GrowthZum subscription does not permit you to systematically extract, package or resell GrowthZum-derived prospect information as a standalone database or data-broker product.

Using prospect information for your own legitimate sales and business-development activity remains permitted subject to these Terms and applicable law.

Part Z

Security And Technical Restrictions

87.SECURITY TESTING

You must not carry out penetration testing, vulnerability scanning or other intrusive security testing against GrowthZum without prior written permission.

Genuine security issues should be reported to:

88.AUTOMATED ACCESS

You must not use bots, scripts, scrapers or automated systems to extract information from GrowthZum except through functionality or APIs that GrowthZum expressly provides or authorises.

89.REVERSE ENGINEERING

Except where applicable law expressly prevents such a restriction, you must not:

  • reverse engineer;
  • decompile;
  • disassemble;
  • copy;
  • recreate; or
  • attempt to discover proprietary source code or algorithms underlying GrowthZum.
Part AA

Events Outside Our Control

90.FORCE MAJEURE

Neither party will be liable for delay or failure caused by events outside its reasonable control.

Examples may include:

  • widespread internet outages;
  • major cloud-service outages;
  • natural disasters;
  • war;
  • terrorism;
  • civil disorder;
  • labour disputes;
  • government action;
  • epidemics;
  • major cyberattacks;
  • power failures; or
  • failures of critical third-party infrastructure.

This does not excuse payment obligations arising before the relevant event.

Part AB

Changes To These Terms

91.UPDATES TO THESE TERMS

GrowthZum may update these Terms.

Reasons may include:

  • changes to GrowthZum;
  • new features;
  • legal requirements;
  • regulatory guidance;
  • security requirements;
  • third-party service changes; or
  • clarification of existing provisions.

Where a change materially affects an existing paid customer’s rights, GrowthZum will provide reasonable notice where practicable.

Updated Terms will display the relevant effective or last-updated date.

Continued use of GrowthZum after updated Terms take effect constitutes acceptance where legally permitted.

If you materially object to a change affecting your paid subscription, you may cancel before the relevant change becomes effective.

Part AC

General Legal Terms

92.ENTIRE AGREEMENT

These Terms, together with documents expressly incorporated into them, constitute the agreement between you and GrowthZum concerning the Service.

They supersede previous discussions or representations concerning the same subject matter, except where fraud is involved or applicable law prevents exclusion.

93.NO WAIVER

A delay by either party in exercising a contractual right does not automatically waive that right.

94.SEVERABILITY

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.

Where possible, an invalid provision will be interpreted or modified only to the minimum extent required to make it enforceable.

95.ASSIGNMENT

You may not transfer your rights under these Terms to another person without GrowthZum’s written consent.

GrowthZum may transfer this agreement as part of:

  • a corporate restructuring;
  • merger;
  • acquisition;
  • sale of the business;
  • sale of substantially all relevant assets; or
  • transfer to an affiliated company,

provided this does not materially reduce your contractual rights.

96.NO PARTNERSHIP OR AGENCY

Nothing in these Terms creates:

  • a partnership;
  • employment relationship;
  • agency relationship;
  • franchise;
  • fiduciary relationship; or
  • joint venture

between you and GrowthZum.

97.THIRD-PARTY RIGHTS

Except where expressly stated otherwise, a person who is not party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.

Part AD

Governing Law And Disputes

98.GOVERNING LAW

These Terms and any dispute or non-contractual obligation arising from them are governed by the laws of England and Wales.

99.JURISDICTION

Subject to mandatory legal rights that cannot be excluded, the courts of England and Wales will have exclusive jurisdiction over disputes arising from or relating to these Terms.

100.DISPUTE RESOLUTION

Before starting court proceedings, each party should make reasonable efforts to resolve the dispute informally.

A party should provide written details of the dispute to the other party.

The parties should then attempt in good faith to resolve the issue.

Nothing in this clause prevents either party from seeking urgent injunctive relief or bringing proceedings where reasonably required to preserve a legal right.

GrowthZum customers agree to follow these principles when using outreach functionality.

Users must not deliberately conceal or falsify their identity when sending commercial communications.

  1. 1.Legitimate purpose

Outreach must relate to a genuine product, service or legitimate business purpose.

  1. 1.Recipient relevance

Users should make reasonable efforts to ensure the recipient has a genuine professional or commercial connection to the subject of the communication.

  1. 1.Opt-outs

Where applicable, recipients must have an appropriate means of requesting that further marketing communications cease.

  1. 1.Suppression

Users must honour valid opt-out requests.

  1. 1.Accuracy

Users must not knowingly include materially false statements in outreach communications.

  1. 1.Frequency

Users should avoid repeatedly contacting recipients at unreasonable intervals.

  1. 1.Legal assessment

Users remain responsible for determining whether a recipient is:

  • a corporate subscriber;
  • sole trader;
  • partnership;
  • individual;
  • consumer; or
  • another relevant category.
  1. 1.International outreach

Where recipients are located outside the United Kingdom, users are responsible for complying with applicable local laws.

Schedule 2 — AI And Automation Principles

  1. 1.Human responsibility

AI assists the user.

It does not replace the user’s responsibility for a campaign.

  1. 1.Generated information

Information inferred or generated by AI should not automatically be regarded as verified fact.

  1. 1.Personalisation

Users should ensure AI-generated personalisation is appropriate before sending it.

  1. 1.Sensitive information

AI must not deliberately be used to generate invasive personalisation based on unlawfully obtained or unlawfully processed sensitive information.

  1. 1.Misrepresentation

Users must not instruct GrowthZum to create communications that materially misrepresent the identity of the sender or falsely claim personal knowledge that does not exist.

  1. 1.High-risk uses

GrowthZum must not be used to automate regulated high-impact decisions for which the Service was not designed.

Schedule 3 — Fair Use Policy

GrowthZum is intended for genuine business use.

Fair use means using resources included within a subscription in a manner reasonably consistent with ordinary sales, prospecting and business-development activities.

GrowthZum may investigate usage involving:

  • unusually high automated traffic;
  • repeated account creation;
  • attempts to bypass plan limits;
  • systematic extraction of data;
  • resale of GrowthZum-derived data;
  • excessive AI usage caused by unauthorised automation;
  • activity materially degrading the Service for other users;
  • unusual sending behaviour; or
  • usage inconsistent with the plan purchased.

Where appropriate, GrowthZum may contact the customer to resolve an issue before imposing restrictions.

For serious abuse, GrowthZum may immediately restrict relevant activity.

Schedule 4 — Third-Party Integrations

GrowthZum may support integrations with services including:

  • email providers;
  • data providers;
  • professional networks;
  • artificial-intelligence providers;
  • payment processors; and
  • other business software.

Availability may change.

Connecting an external service authorises GrowthZum to use permissions granted through that provider only as reasonably necessary to provide the requested functionality and legitimate security, support and compliance functions.

Disconnecting an integration may prevent GrowthZum from completing scheduled activities associated with that integration.

Where appropriate, you should also revoke authorisation directly through the relevant third-party provider if you wish to terminate that provider’s access token.

Schedule 5 — Important Commercial Acknowledgements

By subscribing to GrowthZum, you acknowledge that:

  1. 1.GrowthZum is a software platform and not an outsourced sales agency.
  2. 2.GrowthZum does not promise any particular number of customers, meetings, sales or replies.
  3. 3.Prospect information may contain errors.
  4. 4.AI-generated research and recommendations may contain errors.
  5. 5.Email verification reduces but does not eliminate the possibility of invalid or incorrect addresses.
  6. 6.Third-party platforms may alter their rules, APIs and availability.
  7. 7.Marketing and outreach laws vary according to recipient, location and communication channel.
  8. 8.You remain responsible for deciding whom you contact and what you send.
  9. 9.You must respect valid opt-outs and objections.
  10. 10.A GrowthZum subscription purchases access to software and applicable usage allowances, not a guaranteed commercial outcome.
  11. 11.GrowthZum may pause activity that presents a significant deliverability, security, legal or abuse risk.
  12. 12.GrowthZum’s prospect scoring and recommendations are intended to assist your judgement and do not replace it.
